Retirement Replacements

Whereas the new State Teachers Retirement System reforms could soon result in a high level of retirements, and

Whereas those retirements could have a substantial and significant impact on existing programs,

Resolved that the Academic Senate reaffirm its position that colleges continue to follow Title 5 regulations to fill all retirement positions as soon as possible with only full-time tenure-track faculty.

Roll-over Contracts

Whereas the use of roll-over contracts would imperil the commitment of the California Community Colleges to a system of earned tenure grounded in peer review, due process, and academic freedom, and

Whereas the Academic Senate for California Community Colleges has not historically engaged in positions on matters that are collectively bargained and has historically deferred to collective bargaining organizations positions when queried on such issues, and

Student Removal

Whereas, California Education Code 76032 states that "the adopted rules of student conduct may authorize an instructor to remove a student from his or her class for the day of the removal from class and the next class meeting";

Whereas, This provision presumes the class is a traditional college class that meets on alternate days (i.e. MWF or TTH) while most vocational classes meet daily and/or at off campus sites where many student services are not immediately available;

Learning Center Faculty

Whereas Academic Senate resolution 19.03.0 Fall 1996 recognized the importance of learning centers, tutorial centers, and learning assistance faculty, and

Whereas the Academic Senate in resolution 16.1 Fall 1995 directed the Academic Senate to prepare a position paper defining the role of library faculty in California community colleges, and said paper was adopted by resolution 16.1 Spring 1996, and

Whereas the Academic Senate adopted a position paper "The Role of Counseling Faculty in California Community Colleges," resolution 8.1.0 Fall 1994, and

No classroom Faculty and 75:25

Whereas there are many essential faculty who are nonclassroom faculty, including, but not limited to, counseling faculty, library faculty, media/technology specialist faculty, and many others,

Resolved that the Academic Senate direct the Executive Committee to study and make recommendations for consideration at a future session the possible inclusion of all faculty in the 75:25 ratio of full-time to part-time faculty under AB 1725.

Hiring Practices and Implementation

Whereas there have been alleged Equal Employment Opportunity (EEO) violations in filling administrative positions, especially during college reorganization when allegedly improper lateral transfers have occurred, and

Whereas there have been reports of hiring practice violations with respect to minimum qualifications, especially in the case of adjunct/part-time faculty, and

Whereas the Academic Senate for California Community Colleges has supported and has been involved in writing the hiring requirements of AB 1725, Affirmative Action, and other laws and regulations,

Part-time Faculty Service Credit

Whereas full-time faculty receive all of their service credit reported to the State Teachers Retirement System (STRS) for purposes of determining benefits upon retirement, and some part-time faculty working 60% receive 50% credit, and

Whereas part-time faculty do not receive full retirement credit for service credit to determine their benefits for retirement, and

Whereas some of the part-time faculty are losing 10% or more of their service credits,

Accuracy of 75/25 Statistics

Whereas 75/25 statistics reported by both districts and the state Chancellor's Office are often inaccurate, giving a false sense of growth of full-time faculty,

Resolved that the Academic Senate recommend that local senates carefully monitor the 75/25 reported statistics at each college, and

Resolved that the Academic Senate recommend to the Chancellor's Office that its review 75/25 statistics that are collected and reported in order that such statistics more accurately reflect the full to part-time ratio at each college and district.

75/25 Statistics Investigation

Whereas the Governor in his veto message of AB 1353 addressed the 75/25 ratio and implied that it is being implemented, and

Whereas many programs and departments in community colleges are being seriously undermined by having over 70% of their courses taught by part-time teachers despite statistics indicating otherwise,

Resolved that the Academic Senate direct the Executive Committee to investigate how the 75/25 data are reported, collected, analyzed, and used.

Reaffirm Support of AB 1353/New Faculty

Whereas the Academic Senate for California Community Colleges has a longtime commitment to the hiring of more full-time faculty, and

Whereas the Governor vetoed AB 1353, which called for $15 million for new full-time faculty hires, and

Whereas Chancellor Nussbaum has announced that he is not supporting reintroducing AB 1353,

Resolved that the Academic Senate urge the Chancellor to reconsider and support a reintroduced AB 1353.
